FINES LIST APPROVED FOR BUILDING CONTROL TRANSGRESSIONS
A list of fines for building control transgressions has been approved by the Chief Magistrate of Mossel Bay and will be implemented from early 2017. A total of 23 fines has been determined for misconduct or transgressions of the National Building Regulations and Building Standards Act, No 103 of 1977.
In practice transgressors will first receive a warning via a notice. Should compliance not be reached by the date indicated on the notice, an applicable fine will be issued. If the owner persists with the illegal activities after the fine was issued, the Building Inspector can continue issuing additional fines until compliance has been reached.
The following are specific problematic areas encountered by the Building Control section, and the following fines will be applicable:
Section 14.4:
Occupying a building without the written approval of the Local Authority: R2 500.
Regulation A22
Not requesting foundation or plumbing inspection as per building regulation: R2 500.
Regulation F9
Failure to remove waste material on site: R1 500.
Regulation F11
Failure to provide approved sanitary facilities on site for all personnel employed on or in connection with the erection or demolition of any building: R1000.
A fine of R100 per day up to a maximum fine of R4 000 will be levied for the illegal erection of any building without the written approval of the local authority (Section 4 of the Act).
The fine for submitting false or fraudulent documents to obtain an Occupation Certificate (Art 14 (3)) will attract a fine of R2 000.
Should transgressions result in the need to prosecute offenders, cases will be heard in the Mossel Bay municipal court.
